[Kpop News] SM Entertainment Sues Kris For Illegal Use of Exo`s Image

This might be the end for Kris

On 31 July, reps from SM Entertainment announced that they have filed litigation against ex-Exo member Kris, Kris' advertiser and the production company that hired Kris as their actor, for improper and illegal usage of Exo's fame and brand name. The case is filed with the Beijing Court of the PRC.

SM claims 'Kris exploited Exo's fame for himself and illegally participated in multiple movies, commercials, events and prize ceremonies. His acts are unethical, abuses the law and abuses the trust between him and the company and other members of Exo'.


Back in May 2014, Kris sued SM for exploitation and demanded nullification of the contract between him and SM. Following suit, two other Chinese Exo members Luhan and Tao left Exo in the same fashion. In February this year, SM pursued to file litigation against Luhan and his advertiser.


The following is a translated transcript of SM's declaration:


SM Entertainment being ex-Exo members Kris and Luhan's sole legal management company, have filed for litigation against Luhan and his advertiser in February 2015 for their illegal pursuit of entertainment businesses. Regarding Kris' case, we have now also filed litigation against Kris, his advertiser and his employing film production company. The case is file with courts in China on 30 July.


Kris had sued our company in May 2014 and have left our company without rights. He exploited Exo's fame and image for his own gains and illegally benefited from multiple movies, commercials, activities and prize ceremonies. These businesses have hurt SM and other Exo member's interests and rights. In addition, this has cause serious contractual conflicts between SM and multiple international partnering companies which resulted in serious financial loss. His actions were unethical, lawless and a breach of trust from SM and other members of Exo.


Before the Chinese court passes judgement, the contract between Kris and SM is still valid. Any business resulting in benefit of Kris between now until further notice will qualify as a breach of contract. For this, Kris will have to bear legal liability. We also declare that companies and individuals in aid of Kris' illegal business will also be subject to our legal actions.


SM Entertainment will continue to protect our company's rights, together with Exo's and that of partnering companies.


My fanboy thoughts:

Hmm... I think Kris really had it this time. SM will probably win the case as they have the money and the contract will definitely be in their favor. Not to mention, companies won't hire Kris during this time, so Kris is pretty much on his own from now on. What do you guys think?
